Welcome to MemoryVerse! These Terms of Service ("Terms") govern your use of the MemoryVerse mobile application ("App," "Service," or "MemoryVerse"). By accessing or using MemoryVerse, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using MemoryVerse, you agree to:

• Comply with these Terms of Service
• Comply with our Privacy Policy
• Comply with all applicable laws and regulations
• Be responsible for your account activity

If you are using MemoryVerse on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must meet the following requirements to use MemoryVerse:

• You are at least 13 years old (or the minimum age in your jurisdiction)
• If under 18, you have parental or guardian consent
• You are not prohibited from using the Service under applicable laws
• You have not been previously banned from MemoryVerse

3. Account Registration and Security

3.1 Account Creation

To use MemoryVerse, you must create an account by providing:

• A valid email address
• A secure password
• A display name

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Not sharing your account with others

3.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. License and Use

4.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use MemoryVerse for personal, non-commercial purposes in accordance with these Terms.

4.2 Restrictions

You may NOT:

• Modify, reverse engineer, or decompile the App
• Copy, distribute, or create derivative works
• Use the App for commercial purposes without permission
• Attempt to gain unauthorized access to our systems
• Use automated tools or bots to interact with the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App to violate any laws or regulations
• Impersonate others or provide false information
• Harass, abuse, or harm other users
• Upload malware, viruses, or malicious code

5. Bible Content and Translations

5.1 Public Domain Translations

MemoryVerse provides access to 7 public domain Bible translations including KJV, ASV, WEB, and others. These translations are in the public domain and free to use.

5.2 Accuracy Disclaimer

While we strive for accuracy, Bible translations and verse references may contain errors. MemoryVerse is provided "as is" for educational and spiritual purposes. Always verify important passages with authoritative sources.

5.3 AI-Generated Content

AI-generated verse explanations and context are provided for educational purposes only. They do not constitute religious advice or official church doctrine. Always consult with spiritual leaders for guidance on matters of faith.

6. User Content and Conduct

6.1 Your Content

You may create content in MemoryVerse including:

• Profile information (display name, bio, avatar)
• Study notes on verses
• Prayer recordings (if you choose to save them)

6.2 Content License

By submitting content to MemoryVerse, you grant us a worldwide, royalty-free license to use, store, and display your content solely to provide the Service. You retain ownership of your content.

6.3 Prohibited Content

You may not post content that:

• Is illegal, harmful, or offensive
• Violates intellectual property rights
• Contains spam or advertising
• Promotes violence, hatred, or discrimination
• Contains false or misleading information
• Violates the privacy of others

7. Gamification Features

7.1 Virtual Items

MemoryVerse includes gamification features such as XP, levels, streaks, and achievements. These virtual items:

• Have no monetary value
• Cannot be transferred or sold
• May be modified or removed at our discretion
• Are lost if you delete your account

7.2 Leaderboards

Your display name, XP, level, and streak may appear on public leaderboards. By using MemoryVerse, you consent to this display. You can remove yourself from leaderboards by deleting your account.

7.3 Fair Play

Cheating, exploiting bugs, or manipulating the gamification system is prohibited and may result in account termination.

8. Subscriptions and Payments

8.1 Free Service

MemoryVerse is currently free to use. We may introduce paid features or subscriptions in the future with advance notice.

8.2 Future Pricing

If we introduce paid features:

• Existing features will remain free or you will be grandfathered in
• Pricing will be clearly displayed before purchase
• Payments will be processed through app stores (Apple, Google)
• Refunds will be subject to app store policies

9. Intellectual Property

9.1 Our Rights

MemoryVerse and all related content, features, and functionality are owned by Pintayo and protected by copyright, trademark, and other intellectual property laws.

9.2 Trademarks

"MemoryVerse," the MemoryVerse logo, and related marks are trademarks of Pintayo. You may not use our trademarks without prior written permission.

9.3 Copyright Infringement

If you believe content in MemoryVerse infringes your copyright, please contact us at [email protected] with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

10. Privacy and Data

Your use of MemoryVerse is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using MemoryVerse, you consent to our privacy practices.

11. Third-Party Services

MemoryVerse integrates with third-party services including:

• Supabase (database and authentication)
• Firebase (analytics)
• Sentry (error tracking)
• AI services (Perplexity, OpenAI, Anthropic)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

12. Disclaimers and Limitations of Liability

12.1 "As Is" Service

MemoryVerse is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness
• Uninterrupted or error-free operation

12.2 No Religious Advice

MemoryVerse is a tool for Scripture memorization and does not provide religious, spiritual, or theological advice. Consult with qualified religious leaders for guidance on matters of faith.

12.3 Limitation of Liability

To the maximum extent permitted by law, Pintayo and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or profits
• Loss of goodwill
• Service interruptions
• Damages arising from use or inability to use the Service

Our total liability shall not exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.

12.4 Indemnification

You agree to indemnify and hold harmless Pintayo, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of MemoryVerse
• Your violation of these Terms
• Your violation of any rights of others
• Your content submitted to the Service

13. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue MemoryVerse at any time
• Add or remove features
• Change pricing or introduce paid features
• Update these Terms with or without notice

We will make reasonable efforts to notify you of material changes. Continued use after changes constitutes acceptance.

14. Termination

14.1 Your Right to Terminate

You may stop using MemoryVerse and delete your account at any time through the app settings.

14.2 Our Right to Terminate

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse or harass other users
• Attempt to harm or exploit the Service

14.3 Effect of Termination

Upon termination:

• Your access to MemoryVerse will cease
• Your data will be deleted according to our Privacy Policy
• You must stop using the App and delete it from your devices
• Provisions that should survive termination (e.g., liability, indemnification) will remain in effect

15.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in class actions.

15.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or other urgent matters.

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pintayo regarding MemoryVerse.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any party at our discretion.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or technical failures.
